Dispute Resolution Policy

Informal resolution, mediation, arbitration and jurisdiction.

19.1 Informal Resolution

Parties are encouraged to first attempt to resolve a dispute directly (for buyer-vendor disputes) or through AMTA's customer support team, who may facilitate a resolution before any formal process begins.

19.2 Mediation and Arbitration

Disputes not resolved informally may be referred to mediation and, if unresolved, to arbitration under the Arbitration and Mediation Act 2023, with the arbitration seated in Abuja, Nigeria, conducted in English.

19.3 Jurisdiction and Venue

Where a dispute is not subject to arbitration or mediation, or where a party seeks urgent injunctive relief, the courts of the Federal Capital Territory, Abuja have jurisdiction.

19.4 Legal Costs and Fees

Except as otherwise ordered by an arbitrator or court, each party bears its own legal costs in a dispute; the prevailing party may seek recovery of costs where the applicable arbitration rules or Nigerian law so provide.

19.5 Binding Nature of Resolution

A decision reached through arbitration under this Policy is final and binding on the parties, subject only to the limited grounds for challenge available under the Arbitration and Mediation Act 2023.
